Mayor de Blasio Signs Legislation to Ensure Experienced School Bus Drivers Are Behind the Wheel; Create Punitive Segregation Reports; Improve Campaign Disclosures and Voter Guides

Mayor Bill de Blasio signed five pieces of legislation today—Intro 449, relating to school bus driver wages; Intro 292-A, relating to reporting on punitive segregation; Intro 6 and Intro 148-A, relating to campaign finance; and Intro 441, relating to voter guides.

The first bill, Intro 449, establishes a one-year grant program to reverse significant cuts to the wages of school bus drivers, attendants, dispatchers and mechanics—which resulted in severe hardship for long-serving employees and risked pushing the most experienced drivers and matrons out of the system. Eligible employees currently work at one of 16 bus companies awarded a contract for the 2014-2015 school year and worked for a bus company that had a contract that ended in June 2014, or worked for a company that used to provide bus service and were on or eligible to be on the Master Seniority List. Eligible employees must be able to demonstrate that they are currently earning a lower hourly wage than the wage they earned when they last worked for a school bus contractor. The grant program, which is capped at $42 million, will be administered by the Department of Small Business Services, and will sunset after the 2014-2015 school year. The bill was approved by the City Council at the Stated Meeting on August 21.

The second bill, Intro No. 292-A, requires the Department of Correction to provide a report on the conditions of prisoners in the city’s jails who are housed in punitive segregation and the Clinical Alternative to Punitive Segregation (CAPS) program. Starting January 1, 2015, the Department of Correction, in cooperation with the Department of Health and Mental Hygiene, will be required to post a quarterly report on the department’s website containing information, disaggregated by facility and housing category, on the inmates housed in punitive segregation and CAPS, and several dozen metrics including information about the use of force, demographic information, and access to medical and mental health services. The bill was approved by the City Council at the Stated Meeting on August 21. In his remarks, the Mayor thanked the bill’s sponsor, Council Member Daniel Dromm, for supporting this legislation, and praised the bill for helping effectively manage the city’s jails and support better outcomes for the incarcerated.

The third bill, Intro 6, requires all literature, advertisements or other communications paid for by a candidate or on behalf of the candidate running for City office to disclose that it was paid for or authorized by such candidate. The bill was approved by the City Council at the Stated Meeting on August 21. In his remarks, the Mayor thanked the bill’s sponsor, Council Member Dan Garodnick, for helping create a transparent election process.

The fourth bill, Intro 148-A, increases disclosure requirements for independent expenditures in City elections. Intro 148-A would require entities making independent expenditures to reveal to the Campaign Finance Board the identities of the individuals who run their contributing entities. In addition, this bill would require independent entities producing election-related communications to include in or on the communications their identities and their top three donors, and would direct individuals to find more information on a new City campaign finance website. In his remarks, the Mayor thanked the bill’s sponsor, Council Member Brad Lander, for his leadership on this legislation.

The fifth bill, Intro 441, amends the voter guide law so that if there are no contested elections for the office of Mayor, Public Advocate, Borough President, Comptroller or City Council and no administrative action or determination of a court to include a ballot proposal or referendum 60 days or more prior to the election, the board will not publish and distribute the guide and instead make it available on its website. In his remarks, the Mayor thanked the bill’s sponsor, Council Member Ben Kallos, for championing this fiscally responsible legislation.
